TOKI Terms of Service
These terms are the agreement between you and us for your use of TOKI. Please read them. By creating an account or using the app, you accept them. If you do not accept them, please do not use TOKI.
1. Who we are
TOKI is operated by Digital Living Co., Ltd., 35 Soi Bangwaek 2, Khuha Sawan, Phasi Charoen, Bangkok, Thailand 10160 ("we", "us"). You can reach us at toki@brivfy.com.
2. What TOKI does
TOKI is a real-time voice translation app. You hold a talk button and speak; your speech is transcribed, translated, and spoken back in the other language. Translation is performed by artificial intelligence supplied by a third-party provider, and TOKI requires an internet connection — it does not work offline.
Translations are machine-generated and may be wrong. TOKI is a convenience tool for everyday conversation. Do not rely on it where an error could cause harm or legal or financial consequences — including medical, legal, financial, safety-critical or emergency situations. For those, use a qualified human interpreter.
3. Who may use TOKI
You must be at least 13 years old to use TOKI, and old enough to form a binding contract where you live. TOKI is not directed at children.
4. Your account
- Give accurate details when you register, and keep them current.
- Your account is yours alone. Keep your sign-in credentials secret, and tell us promptly if you believe someone else has used your account.
- You are responsible for activity that happens under your account.
- You can delete your account at any time from Profile → Settings → Delete Account.
5. Translation time and credits
TOKI measures use as seconds of translation. New accounts receive a free allowance. Where additional credits are offered for purchase, the price and the amount are shown before you buy, and purchases made inside the Android app are processed through Google Play.
- Credits pay for access to the service and have no cash value.
- Credits are not transferable between accounts.
- Refunds are handled under the rules of the store you purchased through, and under applicable consumer law.
- If you delete your account, any unused credits are forfeited.
6. Acceptable use
Do not use TOKI to:
- break the law, or infringe anyone's rights;
- record or translate someone without the consent the law requires where you are — recording rules differ by country, and complying with them is your responsibility;
- harass, threaten, defraud or abuse anyone;
- attempt to breach, overload, reverse-engineer or disrupt the service, or access it by automated means;
- resell or redistribute the service without our written permission.
We may suspend or close an account that breaks these rules.
7. Your content
Your speech, transcriptions and translations remain yours. You grant us only the permission we need to run the service for you: to process your audio and text, transmit it to our AI provider to produce a translation, and store your saved conversations so you can reopen them. We do not use your conversations to advertise to you, and we do not sell them. How your data is handled is described in our Privacy Policy, which forms part of these terms.
8. Our content
The TOKI app, its name, its logo and its software are ours and are protected by intellectual property law. These terms give you a personal, non-exclusive, revocable licence to use the app — nothing more.
9. Availability and changes
We aim to keep TOKI running, but we do not promise it will be uninterrupted or error-free. We may change, suspend or discontinue features, and we may set or adjust fair-use limits. We will give reasonable notice of a material change where we can.
10. Disclaimers and liability
To the fullest extent the law allows, TOKI is provided "as is", without warranties of any kind, including any warranty that translations are accurate, complete or fit for a particular purpose.
To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for loss arising from your reliance on a translation. Our total liability to you for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or THB 1,000.
Nothing in these terms excludes liability that cannot lawfully be excluded, including your rights as a consumer.
11. Ending this agreement
You may stop using TOKI and delete your account at any time. We may suspend or end your access if you break these terms, or if we are required to by law. Sections that by their nature should survive termination — including sections 8, 10 and 12 — do survive it.
12. Governing law
These terms are governed by the laws of Thailand, and the courts of Thailand have jurisdiction over any dispute. If you are a consumer resident elsewhere, you keep the protections of the mandatory law of your country.
13. Changes to these terms
If we change these terms in a meaningful way we will update this page and the effective date above, and give notice in the app where the change is significant. Continuing to use TOKI after a change means you accept it.
